6/12/2007...Circuit Court Judge Paul Crowley rules that UPC Wind acted unlawfully in erecting met towers on the Kortge property on Sevenmile Hill in violation of a prior decision of the State Land Use Board of Appeals (LUBA). Pursuant to the LUBA decsion, UPC does not have a valid permit to site met towers on either the Kortge or Robbins properties on Sevenmile. LUBA had rejected an earlier approval by Wasco County in an appeal brought by local residents Mark Womble and Gary and Linda Casady. LUBA had found that the county's approval was not justified under the county's land use ordinance. When UPC ignored the LUBA decsion and erected towers on the Kortge property anyway, Womble filed suit in Circuit Court June 1 seeking a declaratory judgment and injunction requiring the removal of the towers. In Tuesday's decision granting a preliminary injunction, Judge Crowley ordered the towers on the Kortge property be removed no later than June 30, subject to Womble posting a security bond in the sum of $2,000.00.
